Welcome to CLOTREE.
These Terms & Conditions (“Terms”, “Terms and Conditions”) govern your access to and use of the CLOTREE website, including www.clotree.com, and any related digital services, features, applications, webpages, product listings, ordering facilities and customer-support services made available through the Platform (collectively referred to as the “Platform”).
CLOTREE is the e-commerce brand under which Mayank Das operates and sells products through the Platform.
For the purposes of these Terms:
- “CLOTREE”, “we”, “us”, and “our” mean CLOTREE and its seller/operator, Mayank Das, as applicable.
- “Customer”, “you”, and “your” mean any person who accesses the Platform, creates an account, browses products, places an order, purchases a product, or otherwise uses the Platform.
By accessing the Platform, creating an account, placing an order, purchasing a product, or using the Platform in any other manner, you acknowledge that you have read and understood these Terms and agree to be bound by them, subject to applicable law.
If you do not agree with these Terms, please do not use the Platform or place an order.
- NATURE OF CLOTREE

- compare available options;
- place orders;
- make payments;
- receive products; and
- access applicable customer-support, return, refund and after-sales services.
CLOTREE is intended to make online shopping simpler, more convenient and more accessible.

- ACCEPTANCE OF THESE TERMS
By using the Platform, you confirm that:
- you have read these Terms;
- you understand the principal terms applicable to your use of the Platform;
- you agree to comply with these Terms;
- you agree to the applicable policies referred to in these Terms; and
- you are legally capable of entering into a binding transaction under applicable law.
For an online purchase, CLOTREE may require you to actively confirm acceptance of the Terms before submitting the order.
How the acceptance checkbox works
Before placing an order, the website may display a checkbox such as:
☐ I have read and agree to the CLOTREE Terms & Conditions, Privacy Policy, and applicable Returns & Refund Policy.
The checkbox should be empty by default.
The customer must actively tick the checkbox before completing the purchase.
This means the customer is given a clear opportunity to read the applicable terms and then affirmatively agrees to them.
- ELIGIBILITY
You may use the Platform only if you are legally capable of entering into a binding contract under applicable Indian law.
If you are under the age of legal capacity, you should use the Platform only with the involvement and supervision of a parent or lawful guardian where required by law.
CLOTREE may refuse or restrict transactions where it reasonably believes that a user is not legally capable of entering into the transaction or where applicable law requires such restriction.
- CUSTOMER ACCOUNT
Certain features may require you to create an account.
When creating or using an account, you agree to provide information that is accurate, complete and reasonably current.
You are responsible for:
- maintaining the confidentiality of your password or login credentials;
- protecting your account from unauthorised access;
- providing accurate contact and delivery information; and
- notifying CLOTREE if you reasonably suspect unauthorised access to your account.
You should not permit another person to use your account in a manner that violates these Terms or applicable law.
CLOTREE may restrict, suspend or terminate an account where reasonably necessary to protect the Platform, customers, payment systems or legal interests of the business.
- USE OF THE PLATFORM
You agree to use CLOTREE only for lawful and legitimate purposes.
You must not:
- use the Platform for illegal activities;
- provide fraudulent or misleading information;
- impersonate another person;
- attempt to access another customer’s account;
- interfere with Platform security;
- introduce malware, viruses or malicious code;
- attempt to disrupt Platform operations;
- scrape or systematically copy Platform content without permission;
- misuse coupons or promotional benefits;
- manipulate ratings, reviews or transactions;
- use stolen or unauthorised payment credentials;
- exploit technical vulnerabilities for personal gain;
- place fraudulent orders; or
- otherwise misuse the Platform.
CLOTREE may take reasonable action against activity that violates these Terms or applicable law.
- PRODUCT INFORMATION
CLOTREE attempts to provide accurate and useful information about products displayed on the Platform.
Product information may include:
- product name;
- description;
- photographs;
- specifications;
- size;
- quantity;
- colour or variant;
- price;
- applicable taxes;
- availability;
- warranty information;
- delivery information;
- return eligibility; and
- other relevant information.
CLOTREE makes reasonable efforts to maintain accurate product information, but minor variations may occur in photographs, colour, packaging, dimensions or appearance because of display settings, manufacturing changes, packaging updates or other legitimate reasons.
Where a product feature is materially important to the purchase, customers should review the detailed product information before ordering.
- PRODUCT IMAGES
Product images are provided to help customers understand and evaluate products.
Actual products may occasionally differ slightly in colour, packaging or appearance from images displayed on a screen.
Such ordinary visual variations do not override any express product representation or any legally protected consumer right.
- PRODUCT AVAILABILITY
Products shown on the Platform are subject to availability.
CLOTREE may update stock levels from time to time.
A product being visible on the Platform does not guarantee that it will remain available until the order is finally accepted or processed.
Where an ordered product becomes unavailable after payment, CLOTREE may cancel the affected order or item and process the applicable refund.
- PRICING
All product prices displayed on the Platform shall be presented in Indian Rupees unless otherwise stated.
The total amount payable may include:
- product price;
- applicable taxes;
- delivery charges;
- applicable platform or service charges, if any;
- applicable discounts; and
- other charges specifically disclosed during checkout.
The final payable amount should be reviewed by the customer before placing the order.
CLOTREE aims to ensure pricing accuracy, but technical errors, typographical errors, synchronisation errors or other inadvertent mistakes may occasionally occur.
Where an obvious pricing error has occurred, CLOTREE may take reasonable corrective action, including cancelling an affected order where legally permitted.
Where a paid order is cancelled because of such an error, the amount actually paid by the customer for the cancelled order shall be appropriately refunded.
- TAXES
Applicable taxes will be charged or collected in accordance with applicable law.
Where required, tax information may be reflected in invoices or transaction records.
Customers should ensure that billing information supplied during checkout is correct.
- PROMOTIONS, DISCOUNTS AND COUPONS
CLOTREE may offer promotional prices, discount codes, coupons, cashback, gifts or other promotional benefits.
Every promotion may have specific terms concerning:
- validity;
- eligible products;
- minimum order value;
- maximum discount;
- customer eligibility;
- payment methods;
- geographical restrictions;
- redemption limits; and
- other conditions.
Promotional terms displayed with the relevant offer shall apply to that offer.
Unless expressly stated otherwise, promotions are not automatically combinable.
CLOTREE may restrict or reverse a promotional benefit where it reasonably determines that the benefit was obtained through fraudulent activity, misuse, technical exploitation, duplicate accounts or violation of the promotion’s conditions, subject to applicable law.
- PLACING AN ORDER
When you place an order, you are requesting to purchase the selected products based on the information shown during the ordering process.
Before placing an order, customers should carefully verify:
- product;
- quantity;
- size or variant;
- colour, where applicable;
- delivery address;
- billing details;
- contact information;
- payment method; and
- final order value.
Once submitted, an order may enter processing immediately.
- ORDER ACKNOWLEDGEMENT
After an order is successfully submitted, CLOTREE may send an acknowledgement by email, SMS, website notification, WhatsApp or another electronic communication method.
An order acknowledgement confirms that CLOTREE has received the order request.
Unless expressly stated otherwise, an acknowledgement does not necessarily mean that the order has been finally accepted for fulfilment.
CLOTREE may accept, reject or cancel an order for legitimate reasons in accordance with these Terms and applicable law.
- ORDER ACCEPTANCE
An order will be treated as accepted in accordance with CLOTREE’s transaction process, ordinarily when CLOTREE confirms the order for fulfilment or dispatch.
Once the order is accepted, the transaction shall be governed by:
- these Terms;
- the product information applicable at the time of purchase;
- applicable return/refund terms;
- applicable shipping terms; and
- other transaction-specific terms communicated during checkout.
Electronic order records and communications may form part of the transaction record.
- ORDER CANCELLATION BY CLOTREE
CLOTREE may cancel an order, in whole or in part, where reasonably necessary because:
- the product is unavailable;
- there is an obvious pricing or listing error;
- payment cannot be verified;
- the transaction appears fraudulent or unauthorised;
- delivery is not possible to the supplied address;
- the product becomes subject to a recall or legal restriction;
- a significant technical error affects the order;
- the transaction violates applicable law; or
- other legitimate circumstances arise.
Where a paid order is cancelled by CLOTREE, the applicable refund shall be processed in accordance with law and the applicable refund procedure.
- CUSTOMER CANCELLATION
Customers may request cancellation in accordance with the CLOTREE Cancellation Policy and the stage of order processing.
Cancellation may become unavailable once an order has been dispatched or has reached a stage where cancellation cannot reasonably be reversed.
Where applicable, the amount eligible for refund will be processed according to the Cancellation Policy and applicable law.
CLOTREE will not impose a cancellation charge on a consumer after confirmation of purchase unless such charge is permitted by applicable law and is structured in accordance with the requirements applicable to e-commerce transactions.
- SHIPPING AND DELIVERY
CLOTREE will provide available delivery information during or before checkout, including an estimated delivery period were reasonably possible.
Delivery times can be affected by:
- destination;
- product availability;
- logistics operations;
- weather;
- public holidays;
- transportation disruption;
- regulatory restrictions;
- incorrect customer information;
- unforeseen operational issues; or
- circumstances beyond reasonable control.
Delivery estimates are estimates unless expressly stated to be guaranteed.
Where applicable law provides a consumer remedy for delayed, deficient, defective or otherwise improper delivery, that remedy shall remain available.
- DELIVERY ADDRESS
Customers are responsible for providing a complete and accurate delivery address and contact information.
CLOTREE may not be able to complete delivery where:
- the address is incomplete;
- the address is incorrect;
- the destination is outside the serviceable area;
- the recipient is unavailable;
- delivery is repeatedly refused; or
- other reasonable delivery restrictions apply.
Where additional delivery costs arise because of information supplied incorrectly by the customer, those costs may apply only where lawfully permitted and properly disclosed.
- DELIVERY ATTEMPTS
The logistics provider may make reasonable delivery attempts before marking an order unsuccessful.
Customers should remain available at the supplied address or use any available delivery-rescheduling facility.
Repeated unsuccessful deliveries may result in the order being returned to CLOTREE or the relevant fulfilment location.
The effect of such return on cancellation or refund will be handled according to the applicable policy and applicable law.
- DAMAGED OR TAMPERED PACKAGES
Customers are encouraged to inspect the external condition of the package when delivered.
Where practical, customers should report visible damage, leakage, tampering or other obvious packaging problems as soon as reasonably possible.
Customers may be requested to provide photographs, videos or other information that helps CLOTREE investigate a delivery issue.
Reporting a problem after delivery does not automatically remove any consumer right that cannot legally be excluded.
- RETURNS
Returns shall be governed by the separate CLOTREE Returns & Refund Policy.
The Returns & Refund Policy shall specify, among other things:
- eligible products;
- non-returnable products;
- return periods;
- acceptable return conditions;
- pickup arrangements;
- replacement conditions;
- refund conditions;
- inspection requirements; and
- customer responsibilities.
Where applicable law grants a consumer a right or remedy that exceeds the published return policy, the applicable law will prevail.
- REFUNDS
Refunds shall be governed by the CLOTREE Returns & Refund Policy and applicable law.
Where a refund is approved, CLOTREE will process the refund through the applicable payment/refund mechanism.
Refund timing may depend on:
- payment method;
- banking systems;
- payment gateway processing;
- return verification;
- logistics processing;
- product inspection, where applicable; and
- other relevant circumstances.
Where a third-party payment provider processes the payment, the final credit may take additional processing time after CLOTREE initiates the refund.
- REPLACEMENT AND EXCHANGE
Where replacement or exchange is offered, it shall be subject to the product-specific eligibility conditions and the CLOTREE Returns & Refund Policy.
Replacement or exchange availability may vary depending on:
- product category;
- stock availability;
- size or variant;
- nature of the defect;
- return condition; and
- applicable law.
Where replacement is not reasonably possible, an eligible refund or other remedy may be provided.
- PRODUCT DEFECTS AND CONSUMER REMEDIES
Nothing in these Terms prevents a customer from exercising legally available rights relating to a product that is:
- defective;
- deficient;
- damaged;
- materially different from what was represented;
- incorrectly supplied;
- spurious; or
- otherwise, subject to a remedy under applicable consumer law.
CLOTREE will investigate legitimate complaints and provide an applicable remedy in accordance with its policy and applicable law.
- WARRANTY
Where a product is covered by a manufacturer or seller warranty, the applicable warranty terms will be communicated through the product page, invoice, packaging or related documentation, as appropriate.
Warranty coverage may differ from product to product.
Customers should review:
- warranty period;
- covered defects;
- exclusions;
- service procedure;
- authorised service arrangements; and
- documentation requirements.
Nothing in these Terms removes a mandatory legal warranty or statutory consumer remedy.
- PRODUCT USE AND SAFETY
Customers must use products according to the manufacturer’s instructions, warnings and intended purpose.
Customers must not misuse, modify or use a product in a manner that is contrary to applicable safety instructions.
Where products require age restrictions, specialised handling, installation or other safety conditions, customers must comply with those requirements.
CLOTREE may not be responsible for damage caused solely by misuse, unauthorised alteration or failure to follow reasonable safety instructions, except where applicable law provides otherwise.
- PAYMENT METHODS
CLOTREE may provide payment through one or more methods, including:
- UPI;
- debit cards;
- credit cards;
- net banking;
- digital wallets;
- cash on delivery, where available; and
- other payment methods offered through authorised providers.
Available payment methods may vary by order, location, product, value or other transaction conditions.
- PAYMENT PROCESSING
Payments may be processed through third-party payment gateways or financial service providers.
Customers agree to provide accurate payment information and to use only payment methods that they are authorised to use.
Where payment credentials are processed directly by a third-party payment provider, that provider’s systems and applicable security measures may apply to the payment transaction.
CLOTREE will handle payment-related information in accordance with its Privacy Policy and applicable law.
- PAYMENT FAILURE OR PAYMENT DISPUTE
If a payment fails, is declined, is duplicated, is reversed, or appears to have been debited without a corresponding completed order, CLOTREE may investigate the transaction with the relevant payment provider.
Customers should avoid making repeated payments without checking the payment or order status where possible.
Where an amount has been incorrectly debited and is confirmed as refundable, CLOTREE will take reasonable steps to facilitate the applicable reversal or refund.
- INVOICES AND RECORDS
CLOTREE may issue an invoice or other transaction record electronically.
Customers are responsible for providing accurate billing information where required.
Customers should retain invoices, order confirmations and other transaction records for their own reference.
Electronic records may be maintained by CLOTREE or authorised service providers subject to applicable law and the Privacy Policy.
- CUSTOMER REVIEWS AND USER CONTENT
CLOTREE may allow customers to submit:
- product reviews;
- ratings;
- comments;
- photographs;
- videos;
- questions;
- feedback; or
- other content.
Customers remain responsible for the information they submit.
User content must not:
- be fraudulent;
- be deliberately misleading;
- violate another person’s rights;
- infringe intellectual-property rights;
- contain unlawful or harmful material;
- contain malware;
- impersonate another person; or
- violate applicable law.
CLOTREE may remove or restrict content that violates these Terms or applicable law.
CLOTREE may use legitimate customer reviews or feedback for improving and communicating about its products and services, subject to applicable law and privacy requirements.
CLOTREE will not knowingly represent a fabricated review as the independent opinion of a genuine consumer.
- INTELLECTUAL PROPERTY
The CLOTREE brand and Platform may contain intellectual property including:
- names;
- logos;
- trademarks;
- graphics;
- software;
- website design;
- photographs;

These may include:
- payment verification;
- order verification;
- account monitoring;
- unusual-activity detection;
- transaction review;
- identity verification where reasonably necessary; and
- other lawful security controls.
Where there are reasonable grounds to suspect fraud, unauthorised activity or unlawful conduct, CLOTREE may delay, restrict or cancel a transaction, subject to applicable law.

- material violation of these Terms.
Account action will be taken subject to applicable law.
Any consumer rights that cannot legally be removed will remain unaffected.

The Platform may occasionally be unavailable or partially unavailable because of:

CLOTREE makes reasonable efforts to maintain accurate website information.
However, the Platform may occasionally contain:
- typographical mistakes;
- technical errors;
- outdated information;
- temporary display errors; or
- other inadvertent inaccuracies.
CLOTREE may correct such information as reasonably necessary.
No website correction shall remove a consumer right or remedy that has already arisen under applicable law.
- LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, CLOTREE will not be liable for indirect or consequential losses arising solely from use of the Platform where such limitation is legally valid.
However, nothing in these Terms is intended to exclude or limit:
- liability that cannot legally be excluded;
- statutory consumer rights;
- mandatory product or service remedies;
- liability arising from fraud where exclusion is unlawful;
- intentional misconduct where limitation is unlawful; or
- any other liability that applicable law does not permit CLOTREE to exclude.

To the extent legally permitted, you may be responsible for losses or claims directly caused by your:
- unlawful use of the Platform;
- intentional violation of these Terms;
- fraud;
- deliberate misconduct; or
- infringement of another person’s rights.
This clause does not make the customer responsible for liabilities that are legally attributable to CLOTREE itself or that cannot lawfully be shifted to the customer.
- CONSUMER RIGHTS ARE NOT WAIVED
Nothing in these Terms is intended to take away or unlawfully restrict any consumer protection, statutory remedy or legal right that applies to your transaction.
Where applicable law gives the customer a greater right or protection than a provision in these Terms, the applicable law will prevail.
This is an important principle of these Terms.

- changes in law;
- changes in business operations;
- changes in Platform functionality;
- security improvements;
- new services;
- technical developments; or
- other legitimate reasons.
The revised Terms will be published on the Platform with an updated “Last Updated” date.
For material changes, CLOTREE may provide additional notice where appropriate or required by law.
The Terms applicable to an already completed transaction will generally be those applicable at the relevant time of purchase, subject to mandatory legal requirements.
- SEVERABILITY
If a provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be modified or interpreted to the minimum extent necessary where legally permitted.
The remaining provisions shall continue in effect.
- NO WAIVER
If CLOTREE does not immediately enforce a provision of these Terms, that does not mean CLOTREE has permanently waived that provision or any other right.
- ASSIGNMENT
Customers may not transfer their rights or obligations under these Terms where such transfer is prohibited by applicable law or these Terms.
CLOTREE may transfer or assign its business rights and obligations in connection with a legitimate business restructuring, sale, merger or reorganisation, subject to applicable law.
